ShrubBucket – which operated from facilities in New York, Ohio, New Jersey and Connecticut – personally delivered products to consumers’ homes at a lower cost than retail stores. The company filed for bankruptcy on June 18, 2021, but continued to accept consumer deposits as recently as a week before it filed for bankruptcy. After receiving several complaints about the company’s practices, the Attorney General’s Office (OAG) opened an investigation. After reviewing ShrubBucket’s bankruptcy filing, the OAG found that more than 2,000 consumers had made down payments in May 2021, but the company had never fulfilled its orders or made a refund.
As ShrubBucket is subject to bankruptcy proceedings, the BVG encourages all affected consumers to file a 507 (a) (7) priority request to guarantee their reimbursement. The deadline for submitting the proofs of claim is this next Monday, September 27, 2021.
If consumers have ever filed proof of claim for products that have been paid for and have never been received, then they should file an unsecured priority claim. Consumers who have previously filed unsecured claims but have not filed a 507 (a) (7) priority claim can change their filing.
